Terms of Service

These Terms of Service (“Terms”) govern your access to and use of bySurf TV (the “Service”) operated by bySurf Studios (“we”, “us”, “our”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility, you must be 18 or older

You must be at least 18 years of age to create an account or use the Service. bySurf TV includes documentaries and other material that may be disturbing, graphic, or intended for mature audiences only. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

At registration, you must provide your date of birth. We reject account creation if you are under 18. If we discover that an account was created by a minor or using a false date of birth, we will permanently delete that account and associated data without notice, and cancel any linked subscription.

If you are not 18 or older, you must not register for or use bySurf TV.

2. The Service

bySurf TV is a streaming platform operated by bySurf Studios offering video content, including member-only documentaries and related community features. We may add, change, or remove content and features at any time.

Some content is available without a subscription. Access to member-only documentaries and Producer perks requires an active Producer membership.

3. Accounts

• You must provide accurate registration information and keep your account credentials confidential.
• You are responsible for all activity under your account.
• Notify us promptly if you suspect unauthorized access. We may send you an email alert when a sign-in occurs from a new IP address or network. You can review and revoke active sessions in your account Security settings.
• Display names and profile photos must not impersonate others, infringe rights, or violate these Terms. We may remove a profile photo that is inappropriate or violates these rules without deleting your entire account.
• One person may not maintain multiple accounts to evade restrictions or abuse the Service.
• You may optionally enable two-factor authentication (2FA) in your account area for additional security. 2FA works with compatible authenticator apps on your device, for example Google Authenticator, Microsoft Authenticator, Authy, 1Password, or any other app that supports our TOTP setup flow. You choose which app to use; we do not provide or operate that app, and you are responsible for keeping access to it.
• If 2FA is enabled, you must enter a valid code from your authenticator app when signing in and for certain sensitive actions (such as changing your password or disabling 2FA). You are responsible for safeguarding your device and app. If you lose access to your account or authenticator app, contact us at contact@bysurf.studio. After verifying your identity, we may send a password reset link to your registered email address, resend a signup confirmation email where applicable, or disable 2FA on your account so you can sign in again. We do not know your password and cannot recover it for you directly; you must choose a new password through the reset link we send. We may refuse recovery if we cannot reasonably verify that you are the account holder.

4. Producer membership and billing

• Producer membership is billed on a recurring basis through Stripe, our payment processor. You may choose monthly (€4.99/month) or annual (€47.90/year) billing.
• Our base subscription prices are €4.99 per month or €47.90 per year (EUR, inclusive of VAT where applicable). Depending on your location, Stripe may present prices in your local currency using adaptive pricing and applicable conversion rates. Displayed estimates on our website are non-binding approximations; the amount charged at checkout is determined by Stripe.
• Before payment, we provide pre-contract information including the main characteristics of the digital service, total price, billing interval, and trader details. See our Right of Withdrawal for statutory consumer information.
• By subscribing with the required consent checkboxes, you may request immediate access to the digital streaming service and acknowledge that your statutory right of withdrawal may be lost once performance begins, as explained in our withdrawal information.
• By subscribing, you authorize recurring charges until you cancel. You may cancel renewal at any time in your account dashboard using the Cancel subscription button (two-step confirmation). Cancellation typically takes effect at the end of the current billing period unless stated otherwise. You may also update your payment method via Stripe.
• Within 14 days of the initial contract, EU consumers may exercise their right of withdrawal using our Withdraw from contract form, subject to applicable law and any valid digital-content waiver.
• Refunds after a valid statutory withdrawal are processed within 14 days to your original payment method. Other refunds are handled in accordance with applicable consumer law and our reasonable discretion.
• We may change subscription pricing or features with reasonable notice where required by law. Continued use after a price change may constitute acceptance where permitted.

5. Content warnings and viewer discretion

Some content on bySurf TV depicts real events, accidents, injury, death, or other subject matter that some viewers may find disturbing. You access and view content at your own discretion and risk. We do not guarantee that content warnings will appear for every potentially sensitive scene.

6. Acceptable use

You agree not to:

• violate any applicable law or third-party rights;
• sell, resell, rent, lease, or otherwise commercially transfer access to your account or the Service;
• scrape, reverse engineer, or attempt to extract source video streams or DRM-protected content except as permitted by law;
• circumvent access controls, geo-restrictions, or membership requirements;
• upload malware, spam, or harmful code;
• harass, threaten, defame, or abuse other users or our staff;
• post comments that are unlawful, hateful, sexually exploitative, or otherwise objectionable;
• use the Service for commercial purposes without our written permission.

Household sharing and simultaneous streaming. You may share your account with people in your household and stream on more than one device at the same time. Selling or reselling accounts or access remains prohibited.

We may remove content, restrict features, suspend, or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or others. We may keep an internal record of prior enforcement actions (such as bans or shadowbans, including after an account is restored) to address repeat violations.

We may also permanently delete an account immediately where we determine that is necessary, for example after repeated violations following a ban or appeal. When we do so, we remove the account and associated data stored on bySurf TV (profile, avatar, comments, watch history, and similar information) without a grace period. We will send an email to the registered address explaining the reason. If you had an active Producer subscription, we cancel it automatically as part of that process; the email will confirm that and may include a link to Stripe’s subscription management so you can review billing or confirm cancellation. Linked Discord access is revoked as part of account deletion or enforcement where applicable.

7. Comments and community features

Where comments or reactions are enabled, you retain responsibility for what you post. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and moderate your user content solely to operate the Service. We may remove comments, profile photos, or other user content and restrict accounts without prior notice where appropriate.

8. Discord community (members lounge)

Producer membership may include access to the bySurf Discord server and a members-only lounge channel. Discord is operated by Discord Inc.; your use of Discord is also governed by Discord’s Terms of Service and Discord’s Privacy Policy.

• You may link a Discord account through the bySurf website. One Discord account may be linked to one bySurf account at a time.
• When you connect Discord, you authorize us to identify your Discord account and, where needed, add you to our Discord server and assign a members-lounge role while your Producer membership (or complimentary Producer access) is active.
• When your membership ends or you disconnect Discord in your account settings, we remove lounge access where our systems can do so.
• Public Discord channels may be available without linking. Lounge access requires an eligible membership and successful account linking, unless we grant access manually after support verification.
• You must follow Discord’s rules and our community standards. We and our moderators may remove messages, restrict channels, or revoke lounge access for violations of these Terms or Discord’s policies.
• Release announcements may be posted in designated Discord channels when new shows or episodes are published. You agree that such operational messages are part of the Service.

9. Support tickets

If you are logged in, you may open support tickets in your account dashboard. You agree to provide accurate information and not to abuse the support system (for example by sending spam, duplicate tickets, or unrelated requests).

We may reply in the dashboard, close tickets (for example as resolved, duplicate, or spam), and remove ticket message content from our systems when a ticket is closed. We send one email notification to your registered address when Support staff send their first reply on a ticket; later replies on the same ticket are available in your account dashboard and are not emailed automatically.

Support tickets do not replace emergency services or legal advice. For urgent safety matters, contact the appropriate authorities.

10. Intellectual property

All videos, artwork, branding, software, and other materials on bySurf TV (except user content) are owned by bySurf Studios or our licensors and protected by copyright and other laws. You receive a limited, personal, non-commercial, non-transferable license to stream content through the Service while your access is active.

You may not copy, download (except where explicitly allowed), redistribute, publicly perform, or create derivative works from our content without prior written consent, except as permitted by mandatory law.

11. Third-party services and links

The Service integrates with or links to third parties such as Stripe, Discord, YouTube, and social media platforms. Your use of those services is governed by their terms and policies. We are not responsible for third-party services.

12. Availability and changes

We strive to keep bySurf TV available but do not guarantee uninterrupted or error-free operation. Maintenance, outages, or third-party failures may occur. We may modify or discontinue the Service or any part of it.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that content is complete, accurate, or suitable for any particular purpose.

Mandatory statutory consumer rights in Germany and the EU are not affected by this section.

14. Limitation of liability

To the fullest extent permitted by law, bySurf Studios and its operator shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) €50, except where liability cannot be limited under applicable law (including liability for injury to life, body, or health, or under the German Product Liability Act).

15. Indemnification

You agree to indemnify and hold harmless bySurf Studios from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your user content, or your violation of these Terms or applicable law, except where prohibited by law.

16. Termination

You may stop using the Service at any time. You may also request deletion of your account through your account dashboard; we apply a grace period before permanent removal, as described in the Service and in our Privacy Policy.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. We may permanently delete your account and data immediately in serious or repeated violation cases, as described in section 6. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law rules. If you are a consumer habitually resident in the EU, you also benefit from mandatory protections of your country of residence.

Unless mandatory law provides otherwise, the courts in Berlin, Germany shall have exclusive jurisdiction for disputes arising from these Terms. Consumers in the EU may also bring proceedings in their place of residence where permitted by law.

18. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted with a revised “Last updated” date. Continued use after changes become effective constitutes acceptance where permitted by law. Material changes may be communicated through the Service or by email where appropriate.
