Right of Withdrawal (Widerrufsbelehrung)

This information applies to consumers in the European Union and Germany who purchase a Producer membership for bySurf TV, a digital streaming service operated by bySurf Studios.

1. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement (for example a letter sent by email or our electronic withdrawal form). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Use our electronic Withdraw from contract button to submit a withdrawal declaration online. You will receive an immediate confirmation by email.

2. Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will use the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the digital service begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the service already provided up to the point when you informed us of your withdrawal, compared with the full coverage of the contract.

3. Loss of the right of withdrawal for digital content

The right of withdrawal expires for contracts concerning the supply of digital content which is not supplied on a tangible medium if:

Before checkout, we ask for your express consent to immediate access to the streaming service and your acknowledgment that you lose the withdrawal right once you begin using the service. If you gave that consent and started streaming, the statutory withdrawal right no longer applies to the digital content already supplied. You may still cancel future subscription renewals at any time (see section 5).

5. Cancelling your subscription (distinct from withdrawal)

Ending your recurring Producer membership for future billing periods is not the same as withdrawing from the initial distance contract within 14 days.
